My daughter just got into an accident and totaled my car. This is in Michigan and she is not listed on the insurance. She spends most of the week at her fiance's house (who drives her to work, school, so forth) and comes home for the weekends and rarely uses our cars (once or twice every month or more). So I was recently given a citation during a trip to Northern California. Here's the condensed version; I went out with a group of friends to have dinner and drinks. On 7/24 I was at a Dairy Queen drive thru the person behind me hit the truck I was driving. I was looking at her in the rear view mirror the entire time. She had a cigarette hanging from her mouth that was unlit and she eventually backed up after hitting me. I got out of the truck and looked and I did not see any damage. She then said I didn't move you hit me I then told her No I did not hit you I am in front of you and this truck was never in reverse. Since there was no damage to the truck I did not bother getting any of her information since it was not my fault. On 7/27 I got a call from the police saying she told them I hit her. I gave them my side of the story and they said she had a witness who was a passenger in her car and they will be in touch. I also let them know I had a witness as well. The cop called me back yesterday and wanted to get my insurance information so her and I could exchange information. My question is do I have to give my insurance information to this cop? I did not hit this woman and I think she is trying to get one over on the insurance company. The cop said yesterday I'm surprised the truck does not have any damage because her car does have damage. This truck was a rental truck which was inspected at the time it was dropped back off at the rental company obviously there was no damage to it. This woman looked like she was on something to begin with and I'm guessing she was not paying attention probably looking for a lighter and let off the break and hit me. Which I still don't see how her car would be so damaged. I don't want this con artist having my information. The driver stated that he saw me attempting to park when he was walking to his car but he thought I saw him getting into his car, he said he was in a hurry and was late for work and I should have waited for him to get out first (he had a big ego). I never saw anyone in the car. I am the kind of person that I would have waited and then proceed. Meanwhile I only have liability coverage. My insurance company said that he was at fault- they will not pay for his damages $800. His insurance co. wont pay for mine because they said is 50 - 50 faults, my damages are $1,800 door damages estimated by the other driver claim adjuster. I dont have $1,800 to spend in fixing my car. 2005 Nissan Altima. How can I fight the other party insurance co. to pay for my damages?

Insurance company not willing to pay full value for car?

A couple of weeks ago a lady ran a red light and hit my car. Her insurance company took a week to get me a rental and two weeks later finally go look at my car and determined a total loss. The adjustor was pretty rude about the whole situation (yes I know that's their job) and started in on how my car has extensive hail damage which is not true. There were some dents from hail on the hood and trunk lid but every used car in Oklahoma has hail damage since we have had several storms over the past few years. He said that they would have paid $5900 for the car but because of the hail damage they will only pay $1250 which is ridiculous. I've done my research and the average cost of my car within 200 miles is $6000 and I have received one estimate on repairing all of the damage was $2000 yet he claims it will cost $7000. The dealership I bought the car from just sold a vehicle just like mine with hail damage for $5000. The engine and everything else on the car was perfect. When I told him all of my info he laughed at me and said oh by the way we are only paying for your rental till the 9th so you need to settle quickly, take it or leave it so I said I was calling a lawyer. I'm waiting on the lawyer to call me back but I just want to know, what should I look for to help me. I've already looked at the market in my area and have record of the prices for the same make and model. I can't take it to a body shop because the car is crushed. Any info appreciated.

Just want to know if your supposed to know the exact dates of your tickets when you get insurance. Because I have 4 tickets and when I get quotes online they always tell me to enter the date. ok i was recently in a car accident , jus a rear end nothing to serious. but the rear of my car is pretty bad. bumper is in bad shape , trunk doesnt open , lights are a bit broken but still work. a guy from the other person's insurance company came to take a look at my car and inspect it and estimate damages. he told me that the car will probably be a total loss. he said someone would call me in 2-3 business days to discuss my options. now i guess i will be paid for what my car is worth , which isnt much prolly no more then a $1000. my question is tho , the guy who came told me that one of my options would be if i wanted to keep the car or not. i want to keep the car , it still runs , it still drives. if i still want to keep my car do i still get paid for the damages?

Why did my lawyer tell the car insurance company to pay PIP directly to me when I asked to have my bill paid?

I spoke to my auto insurance company because my lawyer took two months to file my personal injury protection claim. Once, I took action into my own hands then I was assured that the woman handling my case from my car insurance company would see that my PIP paid for my medical expenses because I don't have health insurance. However, another month has passed and I have heard nothing from my lawyer about my case even though I call his office every week. So, today I received a letter in the mail from my lawyer office to my claim insurance person. It has her name on it but my address so I am not sure if it was intentionally sent that way or not. Yet, I read over it and it tells my insurance claim to pay the PIP directly to me and not to the medical company. What do I do about this? Has anyone gone through something similar and can you give me some helpful advice? I don't know if my lawyer is trying to add my PIP with the rest of the money that I will get so he can get a bigger chunk or if he is trying to get my PIP to me instead? We're wanting to get preggers in the near future. We're trying to look at our financial options for insurance. Currently we don't have major medical insurance (I don't need any comments on this, it's not what I'm asking about).
